(1) According to section 32 of the Act, if the owner of the goods agrees to sell the goods in possession at the price of fivefold, such goods shall be given to the owner of the goods.
(2) If the owner does not sell the goods in accordance with sub-rule (1) at Panchkriti Mall, such goods shall be auctioned by competition.
(3) In order to sell seized goods by auction, notice of the auction shall be given in seven days to thirty-five days and published in the daily newspaper of the national level. But the auction sale of the goods going to Sadigali should be done with the approval of the Director General through appropriate means.
(4) During the auction of the goods, the person who bids the highest price, so that it does not fall below the fivefold price, shall sell the goods by auction after giving a maximum period of seven days.
(5) According to sub-rule (4), if the person who bids the highest price does not accept the auction or does not come to accept the bid within the given period, the deposit held by him shall be confiscated and sold by auction to the person who bids the second, third or last highest price respectively according to the requirement.
(6) If no one accepts the auction during the proceedings related to the auction according to sub-rule (1), (2), (3) or (4), the auction shall be re-evaluated and a seven-day notice for the auction shall be published. However, when publishing a notice for the sale of vehicles by auction, every time a deadline of fifteen days should be given, the notice should be published in the daily newspaper of the national level and auctioned.
(7) If the goods cannot be sold even as per sub-rule (6), every time the price is reduced by a maximum of twenty-five percent, and the auction is conducted by an organization wholly or partially owned by the Government of Nepal, and if there is no such organization, the goods shall be sold after negotiation with any other person. .
